Assumption of Risk
I understand that using batting cages, pitching machines, pitching lanes, training equipment, and other areas of Clutch Cages, LLC involves inherent risks, including but not limited to being struck by balls or bats, slips, falls, collisions, equipment malfunction, and other injuries. I voluntarily choose to participate and assume all risks associated with my use of the facility.
Release of Liability
To the fullest extent permitted by Missouri law, I release and discharge Clutch Cages, LLC, its owners, employees, instructors, contractors, agents, and affiliates from liability for injuries, damages, or losses arising from my use of the facility due to ordinary negligence. This release does not apply to gross negligence, reckless conduct, or intentional misconduct.
Facility Rules
I agree to follow all posted rules and instructions, use equipment only as intended, immediately report damaged equipment or unsafe conditions, and understand that failure to follow facility rules may result in suspension or termination of my membership or access without refund.
Cage Rules
A helmet must be worn by anyone hitting. Only one person hits in a cage at a time. Enter a cage from the front only, and never stand on home plate. Bats are swung inside the cages only. No alcohol or tobacco is permitted in the facility or on the premises, and no one under the influence of drugs or alcohol may participate.
24/7 Access
I understand this is a self-service facility that may operate without staff present. I accept full responsibility for my actions while using the facility and agree to exercise reasonable care at all times.
Door Access
I understand that my access code or credentials are for my use only. I will not share my access with others or allow unauthorized individuals to enter the facility. I understand that sharing access or permitting unauthorized entry may result in immediate termination of my membership without refund.
Minors
If I am bringing or supervising a minor, I certify that I am the parent or legal guardian, or otherwise authorized to consent on the minor's behalf, and I accept responsibility for the minor while they are in the facility.
Responsibility for Anyone You Bring
I am responsible for every person who enters the facility using my access code, whether adult or minor. Guests are not permitted inside the cages — only the member and members of their household may hit. I agree to remain present with and supervise any minor I bring, and I certify that I am the parent or legal guardian of that minor or am otherwise authorized to consent on their behalf. I agree to indemnify Clutch Cages, LLC for any claim arising from a person I bring into the facility.
Unaccompanied Access and Minimum Age
I understand the facility operates 24 hours a day without staff present. Members age 15 and older may use the facility unaccompanied. Anyone under 15 must be accompanied by a responsible adult who is present in the facility for the entire session. No one under 15 may operate or use the pitching machines unless an adult is present.
Medical Emergency
I understand Clutch Cages, LLC does not provide medical care. I authorize emergency medical assistance if necessary and accept responsibility for any resulting medical expenses.
Personal Property
I understand that Clutch Cages, LLC is not responsible for lost, stolen, or damaged personal property.
Video Surveillance
I understand that video surveillance is in use throughout the facility for the safety and security of members, guests, and property.
Acknowledgment
I certify that I have read this agreement, understand its contents, and voluntarily agree to all terms. I understand this electronic acknowledgment and signature have the same legal effect as signing a paper document.
